Terms of Service

Welcome to Elite+ Performance Lab (“Elite+,” “we,” “us,” or “our”). By accessing or using our platform at eliteplusacademy.app (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Platform.

1. Eligibility

You must be at least 13 years old to use Elite+.

If you are under the age of majority in your jurisdiction (including under 18 in most regions), your parent or legal guardian must review and agree to these Terms on your behalf and assumes full responsibility for your use of the Platform.

We do not knowingly collect personal information from children under 13.

2. Account Registration

To access most features, you must create an account using a valid email address and password or authenticate via supported OAuth providers (e.g., Google or Discord).

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Promptly notifying us of unauthorized access

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Plans & Subscriptions

Elite+ offers the following tiers:

Free
Match tracking, training log, basic analytics, and limited AI usage (15 lifetime AI messages).

Pro ($6.99/month or $67.99/year)
Includes AI Coach (200 messages/month), Compare, Reports, Mind & Readiness, and Community features.

Premium ($16.99/month or $163.99/year)
Includes all Pro features plus Career Intelligence, club creation, and expanded AI usage (2,000 messages/month soft cap).

All payments are processed securely through Stripe.

By subscribing, you authorize recurring charges until cancellation. You may cancel anytime via your Billing page or Stripe portal.

Payment Failure & Chargebacks

If a payment is declined, reversed, or disputed, we reserve the right to immediately suspend access to paid features.

Refunds

Subscriptions are non-refundable except where required by applicable law. Cancellation stops future billing but does not retroactively refund past charges.

4. Acceptable Use

You agree not to:

• Violate any applicable law or regulation
• Harass, bully, threaten, or abuse other users
• Post hate speech, sexual content, or violent content
• Share private personal information of others
• Attempt unauthorized access to systems or accounts
• Use bots, scrapers, or automation tools
• Circumvent feature limits or security measures

Violation may result in suspension or permanent ban.

5. Community Guidelines

Community features (feed, clubs, messaging, leaderboard) must be used respectfully.

We enforce moderation through:

Content review → Removal → Warning → Suspension → Ban

We reserve the right to remove any content at our discretion.

6. AI-Powered Features

Elite+ uses OpenAI and related technologies to generate AI-driven insights.

By using AI features, you acknowledge:

• AI responses are generated based on your submitted performance data
• AI outputs may contain inaccuracies or errors
• AI insights are informational only
• AI recommendations are not professional coaching, medical, or fitness advice
• You are solely responsible for how you interpret and apply AI output

You agree not to input sensitive personal information into AI prompts.

We may restrict AI access for misuse or abnormal usage patterns.

7. Intellectual Property

All platform content, code, design, branding, and technology are owned by Elite+ Performance Lab.

You retain ownership of your personal performance data.

By posting content to community features, you grant us a non-exclusive, royalty-free license to display that content within the Platform.

8. Data & Cloud Sync

User data syncs automatically to our servers.

In the event of a sync conflict, the server version prevails.

Users may export match and training data via CSV through the Data Export feature.

We may retain certain data as required for legal, accounting, fraud prevention, or security purposes.

9. Service Availability

The Platform is provided on an “as available” basis.

We do not guarantee uninterrupted or error-free operation.

We may modify, update, suspend, or discontinue features at any time.

10. No Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:

• Accuracy of analytics
• Fitness for a particular purpose
• Reliability of AI-generated outputs
• Non-infringement

Use of the Platform is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Elite+ Performance Lab shall not be liable for:

• Indirect or consequential damages
• Loss of data or profits
• Personal injury claims arising from training decisions
• Reliance on AI-generated advice

Our total liability shall not exceed the amount you paid us in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless Elite+ Performance Lab from any claims, damages, liabilities, or legal expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Content you post
• Actions taken based on AI recommendations

13. Termination

We may suspend or terminate accounts for violations of these Terms.

Upon termination:

• Access to paid features ends immediately
• Certain data may be deleted after a reasonable retention period

You may request account deletion by contacting support.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms periodically.

Material changes will be communicated via the Platform or email.

Continued use after updates constitutes acceptance.
